The Supreme Court (SC) on Monday dismissed the bail application of DMK Rajya Sabha member Kanimozhi and Kalaignar TV Managing Director Sharad Kumar in the 2G spectrum case.
The apex court said that the two can go back to the Special Court and apply afresh for bail only after the framing of charges in the case.
Abench of justice G S Singhvi and justice B S Chauhan said that the Special Court can consider the bail application of the two without being influenced by the earlier bail proceedings.
The CBI today opposed the bail plea for the two, saying that the original documents regarding the illegal financial transaction worth Rs 2bn to the DMK family run Kalaignar TV is yet to be recovered and that the accused might tamper with evidence if released on bail.
A vacation Bench of Justice B.S. Chauhan and Justice Swatanter Kumar had last week issued a notice to the CBI, asking it to file its response on the bail pleas in a week.
The apex court had asked the CBI to clarify as to what happened to Rs. 2bn allegedly given to Kalaignar TV by Cineyug Films. It also asked the CBI to state the loss caused to the Government for allocating new 2G licences during A Raja's tenure as the Telecom Minister.
On June 8, the Delhi High Court shot down the bail applications of Kanimozhi and Sharad Kumar in the 2G spectrum case.
The Delhi High Court said that the two accused have strong political connections and the possibility of them influencing witnesses cannot be ruled out.
The two have been in Tihar jail since May 20 after a Special CBI Court turned down their bail applications.
