The Delhi High Court on Thursday stayed the criminal proceedings against Hero MotoCorp, its chairman Pawan Munjal, and employees in an alleged forgery case.
The stay on the operation of the FIR, as well as the trial court ruling, will remain in effect until December 6, the next day of the hearing, according to Justice Swarana Kanta Sharma.
The trial court had ordered the filing of an FIR against them in response to a complaint alleging that Hero MotoCorp created fraudulent bills for Rs 5.9 crore and received tax credits totaling more than Rs 55 lakh.
The company, its chairman, and officials petitioned the Supreme Court to overturn the trial court’s decision.
Meanwhile, the high court directed the parties to investigate the possibility of a settlement.
Senior attorneys Mukul Rohatgi and Maninder Singh, representing Hero MotoCorp, asked the trial court to vacate the FIR and the September 20 ruling.
The criminal proceedings initiated in the case were ‘wholly malafide and illegal,’ according to the plea, and the company and its officials named in the FIR are being harassed and threatened with coercive actions, in addition to being humiliated in front of various governmental and non-governmental agencies.
Following the trial court’s direction, the criminal case was filed on October 5, 2023, on a complaint filed by Roop Darshan Pandey, the promoter of Brains Logistics Pvt Ltd.
