TCS Under Scrutiny: Maharashtra Labour Department Issues Notice Over Alleged Unfair Transfer Practices

The Maharashtra Government’s Labour Department has issued a notice to Tata Consultancy Services (TCS), a major information technology (IT) company, regarding its transfer practices. This action follows a formal complaint lodged by the Nascent Information Technology Employees Senate (NITES), a union based in Pune, with the Ministry of Labour and Employment, accusing TCS of engaging in ‘unethical transfer practices.

According to NITES, TCS has systematically forced more than 2,000 employees to transfer to different cities without proper notice or consultation, causing immense hardship for them and their families.

TCS issued warnings to its employees, stating that non-compliance with transfer directives would lead to disciplinary measures. The company has now taken the questionable step of withholding salaries from employees who resist these mandatory transfers. Harpreet Singh Saluja, President of NITES, strongly criticizes TCS for employing these illicit strategies, compelling employees to either accept forced transfers or resign from their positions.

‘It has come to our attention that you have not reported to the assigned branch as of today. Given your non-compliance with the transfer instructions and the failure to commence your services at the transferred location within the specified 14-day timeframe, the company is implementing an immediate suspension of your salary. Additionally, the company is initiating further disciplinary measures due to your persistent non-adherence to company directives and violation of your employment terms,’ stated the email from the company.
