The flagship company of the Oberoi group was ordered to leave Shimla’s Wildflower Hall luxury hotel by the Himachal Pradesh High Court. Lord Kitchener, the British Army’s colonial era commander-in-chief, once lived on the property. The hospitality chain EIH may now petition the Supreme Court to overturn this decision.
For almost twenty years, there has been a fierce conflict between the Oberoi Group and the state government on who owns the property in Mashobra, which is located in the upper parts of Shimla.
‘The company (EIH) has been advised that the authority has erred in construing the obligations cast on the company as per the terms of the arbitration award…and accordingly, the company has strong merits on facts and law in pursuing a Special Leave Petition before the Supreme Court against the order,’ stated the business in its exchange filing on Saturday. ‘The company intends to pursue such other legal remedies available to it as it may be advised.’
The Himachal Pradesh High Court issued an order on Friday directing the corporation to leave the land and turn over peaceful custody to the state government within two months of the ruling being passed. The court also set a compliance date of March 15, 2024.
