BCA pushes to extend date of filing of I-T return to 5 Oct

On 30th September, the Income tax website on which the returns are required to be electronically uploaded was not functioning properly, BCA said

The Bombay Chartered Accountants' Society has pushed for an extension in the date of filing income tax returns from Sept 30th to Oct 5, 2013, under clause(a) of explanation 2 to Section 139.

According to Explanation 2 to Section 139, a company or any other person whose accounts are required to be audited under the Income Tax Act 1961 or any other law and a working partner of a firm are required to file his income tax return before 30th September of the assessment year.

For assessment year 2013-14, in terms of Rule 12, all such persons were required furnish the return, either electronically under Digital Signature or transmit the same electronically and subsequently submit the verification in ITR V.

For this assessment year, the form of the return had changed and required filling in of substantial data. Further, the tax audit report was also required to be furnished electronically and scanned copies of the financial statements were required to be attached. This resulted in the process of furnishing of the return being delayed.

As regards furnishing of the tax audit report the date for uploading has already been extended till 31st of October 2013 by order dated 26th September 2013. However, returns were required to be furnished by the due date.

Our members from various parts of the country have informed us that on 30th September, 2013 the Income tax website on which the returns are required to be electronically uploaded was not functioning properly possibly due to the heavy traffic and assesses could not access the service, BCA said.

On a number of occasions the message “service unavailable” appeared on the screen. A very large number of returns have therefore remained to be uploaded on account of service not being available on the Department’s website, BCA added.

Delayed furnishing of the return would cause substantial damage as the loss would not be available to be carried forward, certain deductions would also not be available and the assesses would be liable to pay penal interest.

We request that the due date be extended for five days that is till 5th October 2013. This extension of 5 days is necessary as there is an intervening national holiday 2nd October 2013, BCA further said.
